Here is the latest from the Rafter J HOA Board of Directors:

CCR Amendments Vote Results

The Association has completed the vote on the two proposed amendments to the Declaration of Covenants, Conditions and Restrictions (CCRs):

  • Speed Limit Proposal – Article VII, Section 2: General Restrictions
  • Camper Proposal – Article VII, Section 3: Residential and Multiple Dwelling Area: Uses: Restrictions

A total of 258 ballots were received. Pursuant to the CCRs, amendments require approval of not less than 65% of the lot owners (322 affirmative votes) in order to pass and be recorded with the Teton County Clerk. The results were as follows:

  • Speed Limit Proposal: 206 votes in favor
  • Camper Proposal: 221 votes in favor

While both proposals received substantial support, neither achieved the required 65% of all lot owners. Accordingly, both amendments have failed, and no changes will be recorded. The existing CCR provisions remain in full force and effect. Thank you to all owners who took the time to review and vote on the proposed amendments.

Support for Three Proposed CCR Amendments

A new CCR amendment is being proposed. It intends to clarify existing Rules, respond to recent court guidance, and provide long-term structure and predictability for the community. Key Points of the latest amendment proposal:

  • Clarifies Lot Classifications & Uses
    Provides clearer definitions of Residential, Multiple Dwelling, Commercial, and Miscellaneous lots and expressly applies appropriate residential use restrictions to Commercial and Miscellaneous lots where applicable, reducing ambiguity and limiting future interpretation disputes.
  • Defines “Dwelling Units” & Fair Assessments
    Creates a formal definition of “Dwelling Unit,” including applicable units on Commercial and Miscellaneous lots, and establishes that each Dwelling Unit is responsible for HOA dues on a per-unit basis to ensure consistent and equitable cost sharing across the subdivision.
  • Addresses Recent Court Ruling
    Responds to the Wyoming Supreme Court decision regarding Lot 333 by clarifying how residential provisions apply going forward, while fully honoring the Court’s ruling and not restricting the 57 approved apartment units on that lot.
  • Protects Community Character & Capacity
    Acknowledges and incorporates the Master Plan’s 495-unit density framework for future development, while grandfathering all existing dwelling units, preserving approved apartments on Lot 333, and allowing newly defined ARUs as authorized under this amendment.

Fifty signatures are needed to support the proposed lot classifications and uses clarification CCR amendment as well as satellite dishes and trash compactors amendments. Voting on the amendments will occur after fifty signatures are received.

Rafter J Rules Update

Over the past two years, the HOA Board has been working to update the Rafter J Rules for increased clarity as well as to ensure consistency with our governing documents. A summary of the governance update process is available HERE, and the latest draft of the most recently proposed Rule updates is HERE. Thank you to all owners who have provided input into the process and proposed Rules. The HOA Board expects to vote on these Rule changes at the March board meeting.

Common Area Clean-up

Spring arrived early in the valley this year. As you are playing in the parks and walking the pathways and open space trails, you can help by picking up litter and disposing of it. Also, dog owners, picking up an extra pile of dog-do-do would be much appreciated.

Wildfire Preparedness Resources

Residents who would like fiber optic service should contact the SilverLight support team. Installation in Rafter J Townhome areas is pending completion of Townhome Association agreements with Silver Star.
